In Estate Planning and the 2020 Presidential Election

2020 has been quite an interesting year, which will certainly get even more interesting with the upcoming election only a few months away.  With Democratic candidate Joe Biden releasing his proposed tax plan, estate planning attorneys and financial advisors will potentially have very limited time to implement strategies if Joe Biden is elected as the next President of the United States and his tax plan is passed.  The proposed changes to the tax code would have a substantial impact on many individuals and families across the wealth spectrum.  This presentation will provide analysis of certain proposals of the “Biden Tax Plan” as it relates to estate planning transactions (RLTs, ILITs, GRATs, IDGTs, & SLATs) and also discuss potential changes to capital gains tax laws both during a client’s life and upon their passing.  Specifically, the presentation will address the following contained within Biden Tax Plan proposal:

 

Income Tax

 

  • Tax capital gains as ordinary income for taxpayers with over $1M in income and tax unrealized gains at death.
  • Restore the top individual income tax rate to 39.6%.
  • Estate, Gift, & Generation-Skipping Transfer Tax
  • Reduce the exemption amounts from $11.58M per person to $5.79M (or even as low as $3.5M per person).

 

Business Tax Matters

  • Increase corporate tax rate to 28%.
  • Phase-out small business income deductions above $400,000.

 

The presentation is intended on assisting practitioners prepare for the presumed influx in both basic and advanced estate planning transactions in 2020, 2021, and 2022.

 

About Darren Case

DARREN T. Outside of the practice of law, Darren enjoys spending time with his wife and children, taking them on family adventures.  Darren also enjoys training for and competing in Ironman and other triathlon events, supporting ASU Sun Devils and Georgetown Hoyas athletics, and spending time outdoors in Arizona.
