FINCEN issued a final rule in September 2022 on new reporting requirements for most business owners that all estate planners should know about. Local attorney and CPA Gary Fletcher will provide background on the rulemaking process and how you and your client’s duties as an estate planner and business owner will be impacted by the beneficial ownership information reporting requirement under the Corporate Transparency Act.\n \nCongress passed the bi-partisan Corporate Transparency Act to reduce the financing of terrorism via small business entities by requiring an entity to report who owns or controls this entity. The final rules on filing the beneficial ownership information (BOI) report were issued on September 29, 2022. Gary will provide an overview on the definition of a reporting entity, information required by the BOI report, penalties for failing to file the report, deadline to file the report, and who is obligated to file the report.\n \nGary has been following the rulemaking process from its beginning and has unique insights on how it applies to advisors.
